Online Personal Privacy Act is sponsored by Sen. Hollings, Ernest F. [D-SC]. This bill has the status introduced. The senate view in developing the Online Personal Privacy Act was to increase trust and confidence in the Internet, therefore encouraging and propagating better and increased use. The provision raised concerns over the accessibility to personal information by websites, Internet service providers, direct marketers, data brokers and network advertisers (Pagani, 2005). The widespread usage of internet and cloud computing means prompted the need of safeguarding the users’ information from being interfered with. This privacy law has been central to Internet economy. It has a provision for strong preemption. Still, it has an opt-in protection for the sensitive personal information such as financial, health, ethnicity, religious preferences, and sexual orientation.
Improvements are needed to cater for non-sensitive personal information like marketplace purchases. This would be a flexible approach to respond to rapidly growing internet marketing whose tremendous insight could be gained from dialogue among government, internet providers, industry, and consumers of privacy issues.
However, the current law needs some amendments aimed at specific online harms and focus on ways in which the technology can help to safeguard personal information while achieving the primary functions of data collection, usage and transfer between different users (Spindler & Börner, 2002).
With the advancement in technology, the some tools on computers seemingly compile and enhance highly detailed personal profiles and histories. Cookies and web bugs, and other malicious technologies enable the surreptitious collection of individual information, which could promote hackers to compromise user’s information. Therefore, Online Personal Privacy Act should cover up this area and ensure that the privacy breaches are followed with severe consequences. Aggressive enforcement of this law could help in regulating privacy practices concerning most types of information (Michael & Michael, 2014).
