UN Weaknesses

The Syrian nation is characterized with high mountains, a home to diverse ethic as well as religious groups, and a nation of the most productive plains in the world. The nation has been in severe difference and great chaos since the year 2011. Many of the western communities have continuously intervened in the Syrian conflict in a number of ways since the beginning of the turmoil, through imposing a number of unilateral sanctions on the Syrian government, which is lead by Bashar al-Assad.[1] A number of the western nations have also presented the issues concerning Syria to the United Nations Council largely through the League of Arab nations. The presentation of the Syrian clash to the United Nations General Assembly has also been undertaken. Moreover, some of the nations have also proposed a resolution regarding the conflict in Syria at the UN Human Rights Council.[2]

The numerous as well as diverse processes that unfolds around the planet make the world more complicated and varied, which also gives birth to interdependence as well as interconnectedness among the nations of the world. The growing or increasing amount of economic ties between the nations today based on short term gains as well as many other reasons, posses a severe obstacle and limitation towards the implementation of the global governance. In the world today, it becomes very hard to conceive a world without the mention of the United Nations.[3] The United Nations role in the conflict arena of the globe has suffered a major weakness in achieving its mission. The causes for such weaknesses are highly multidimensional and some are attributed to the internal and external organizational problems of the United Nations, including insufficiency of funds, absence of clear mandate, hostility of the host nations, and lack of proper logistics.[4]  

The first United Nations weakness that has been demonstrated by the Syrian conflict is that the United Nations charter does not allow the Security Council the power in order to push for the regime change.[5] Thus, the UN charter is the fundamental norm that governs the modern international relationships among nations and it also acts as the cornerstone for maintaining or sustaining the international peace.  The charter of the United Nations puts down four primary purposes as well as seven principles of the UN. The essence of these four purposes is to initiate a settlement of the international disputes through peaceful means and remove any form of threats to the international peace.[6] Moreover, the vital element of the seven doctrines of United Nations comprises the independence of all the individual members, non-interference in other the operatio of the nations’ internal affairs, as well as the limited use of military power. The charter also establishes that all the member countries desist in their international relations from the employment and threat of armed force against the independence of any other nation. The charter also stipulates that there is nothing that is contained in the present charter, which authorizes the UN in intervening in issues that are essentially within the domestic jurisdiction of any particular nation. The charter does not also require the member nations to submit such issues to settlement. The logic underlying the UN charter clearly points out that the UN must not intervene in any given states internal affairs, unless the UN acts in regard to Chapter VII, which requires the Security Council to determine the existence of any threat of peace or make recommendations of measures in order to restore the international security as well as peace.[7]

Article 41 of the UN charter require the Security Council to decide and take any form of measures, which does not entail the use of force, at the same time as article 42 permits the council to take such a measure by sea, air, or land force whenever necessary in order to restore as well as maintain peace. This means that for the UN to take any given form of action there must be an existence of breach or threat to the international security and peace.  The objective of this action would be to restore the international security and peace. Therefore, the situation in Syria has contributed to a great number of civilian causalities, which is a fact that should draw the attention of the international society. The Syria conflict, however, is a domestic issue by nature because the nation of Syria does not have disputes with its neighboring countries, nor does Syria threaten to apply force against its neighboring states. This implies that the conflict in Syria is not supposed to be discussed under the framework of the Security Council and that the United Nations need not to intervene with the Syria conflict based on Chapter VII of the UN charter.[8]

According to Wells, Chapter VI of the UN charter also allows the Security Council to call upon every nation that is involved in the international dispute to resolve their issues through peaceful measures, including mediations, negotiations, arbitration, conciliation, or to investigate any situation that might contribute to global friction.[9] In totality, the entire charter’ articles regard the UN’s functions and there is no any mention of the authority to make a member state’s regime resign or take a coercive measure to force the regime to step down when it fails to comply.[10] The veto powers that are given to the United States, China, France, and Britain have also been utilized in selective ways, with each nation striving to attain its self interest. Thus, the United Nations has not been able to effectively harness the powers given to these individual states for the restoration of peace as well as security in Syria.[11] In effect, this weakness has resulted into many deaths as well as casualties in Syria, letting alone the prolonged insecurity.

Another weakness that has been attributed to UN from the conflict engulfing Syria is the United States hegemony. The United Nations is an organization with ethos that should be respected by all the member nations irrespective of their mighty, but the United States because of its economic as well as military power, does not regard or respect the United Nations. In the recent times, especially with the escalating situation in the republic of Syria, the United States has chosen war in order to restore peace. Just in the name of ethnic cleansing, the United States has intensified the conflict between the various groups in Syria, including the Sunni. Moreover, in the name of maintaining and upholding the fundamental human rights, the United States has rocketed violence while constantly infringing the sovereignty of Syria in the absolute disrespect of the UN charter.[12]

In addition, in fighting against the oppressive regime in Syria, the United States has simultaneously replaced the UN Security Council with the NATO as well as diplomatic negotiations for peaceful resolution with military action.[13] All these point out at the military ventures, which are directed towards establishing the United States’ dominance.  Besides, the existence of the monopolarity of the world today has significantly permitted the United States the opportunity to preserve irresponsible unilateralism in order to destroy the established rule of the international law.[14] All these actions are meant to safeguard as well as maintain the interest of the United States, while weakening the precepts of the international law under the UN charter. Moreover, the United States has frequently used its veto power selectively in order to advance its international objectives.[15]

The inability or rather inadequacy of the UN charter to provide clear and sufficient power for the Security Council to push for regime change as well as the United States’ hegemony have been well presented in the case Syria conflict[16]. The UN is highly limited to champion for the change of Syrian government in order to bring the war into a stop, otherwise the Syria conflict could have been long resolved[17]. Similarly, the US dominance and selective use of its veto power has seen the war in Syria escalate, thus leading to a lot of suffering, deaths, and casualties. With the power to control the influences of the nations that are vested with veto powers, the UN can comfortably control the dominance and self pursuit of US in efforts to restore and maintain peace within the Syrian nation. Thus, for the United Nations work more effectively, its charter must be rewritten in order to allow the UN more power to deal with international conflicts.[18]
