In this book, the author, John D. Bessler endeavors to cast doubts on the myth that our founding fathers were avid supporters of the death penalty. The author thus tries to demonstrate the founding fathers’ ambivalent and sometimes conflict views on the death penalty. The book explores the evolving nature of capital punishment over the centuries. It also examines the “cruel and unusual punishments” clause as contained in the U.S. Constitution. Bessler is especially critical of the Fourteenth Amendment because it paved way for the application of the Bill of Rights to the states. He thus concluded that we need to declare the death penalty unconstitutional.

The author has also taken a non-biased objective on the issue of death penalty by seeking to demystify the myth that our founding fathers were its strong supporters

In this article, the author dwells on the issue of death penalty in the United States and the tension that surrounds it on if it is still a valid and justified punishment. The article explores the historical context of death penalty, how it came to be adopted in the U.S. And attempted reforms by certain states to abolish this “cruel and unusual punishment”. The article has also reviewed cases that were instrumental in effecting changes to the US legal system on this matter, court decisions on juveniles, women, and people with mental disabilities.

She therefore possesses the necessary knowledge to make informed arguments on the matter under discussion. She has also conducted an in-depth research on the matter by citing extensive case laws and textbooks on death penalty. This gives richness to her work. In addition, work is published in a recognized journal (Journal of Social Sciences).

After reading this article, I can now identify with the author’s statement that the Eight Amendment has been instrumental in sanctioning the death penalty as a “cruel and unusual” form of punishment. Based on the numerous analyses of public opinion and treaties on this matter, I can now draw a connection between the basic human rights treaties that touch on the issue, which is a further indication of just how cruel this form of punishment is, even for a capital offence.

The fact that capital punishment is often viewed as a controversial issue is not new, and the authors to this article have not lost sight of this truth. They are especially observant about the debate on whether death penalty has a deterrent effect on crime, and how such an intensifying debate is likely to have a huge effect on certain policy outcomes. While other studies may have found a weak link on the deterrence effect of capital punishment on crime, this particular article reports of robust deterrence findings. 

Critique/Analysis

I find this to be a useful source because it brings a different perspective to the issue under discussion namely, that there are strong arguments in literature to back the claim for the deterrence effect of capital punishment on crime. This could in turn have huge implications on policies related to death penalty. In addition, both Hashem Dezhbaksh and Paul Rubin are professors of economics and Economics and Law, respectively, at Emory University. As such, their have a sound grasp of the context under study, as evidenced by their arguments in the paper.

So far, all the sources that I have come across appear sustain the argument that death penalty has no deterrent effect on capital crime. However, this particular source seeks to demystify this theory by arguing in favor of the deterrence effect of capital punishment on criminal activities. It would be interesting therefore to assess how such a find could affect the existing policies on the matter at hand.

Numerous studies have over the last few decades endeavored to establish if capital punishment has any deterrent effect on rates homicide incidents. It is from this context that the National Research Council examines current evidence on this issue from a scientific context on their report, “Deterrence and the Death Penalty.” By examining numerous studies and case laws on the issue, the report arrives at a bold conclusion research on the matter so far is not useful in ascertaining if death penalty causes a decrease or increase on homicide rates. The report also failed to identify nay documented evidence if death penalty is a more effective or less effective deterrent of homicide.

The report adds a new twist to the controversial issue of death penalty in that it points out that past studies have failed to compare the effectiveness of death penalty relative to other alternative punishments like life sentence. The report has further added to my knowledge of the death penalty by providing new areas of research that could offer broader insights into the deterrent effects of not just capital punishments, but also noncapital punishments.

The view of death penalty is an inhuman and cruel form of punishment has been the subject of scrutiny by numerous researches. This diversity of viewpoints as contained in the book adds to its richness of content.

The book acts as a useful reminder of resolution by the UN General Assembly in 2007 demanding that all executions be rendered null and void by 2015 given that they contravene the basic human rights.  This serves as a further indication of the inhumane and cruel nature of the death penalty. While the book does not examine if capital punishment is an effective means of deterring crime, it nonetheless, makes for a strong case on finding other alternative means of punishment, besides it.
