Sample Essay on Physical Activity Law & Ethics

Laws are important in preserving order within the society. However, the effectiveness of laws relies on the ability of individuals to act ethically. In a case before the Supreme Court, the plaintiff, a boxer, was suing the defendants, a boxer and boxing promoter, for the harm and compensation for a lifetime injury sustainedbefore a boxing match. While presented his cases, the plaintiffargued that nobody was allowed to take life or cause harm to another person under the federal law. The plaintiff’s attorney argued that an attempt to harm someone amounts to an assault and when the threat is inflicted on the victim it is termed as a battery. Therefore, the first defendant, the boxer was charged with battery and while the second, the promoter, was charged with fraud. The plaintiff argued that the first defendant had full knowledge of what he was doing since he kept on harming the victim which suggested that he had the intention of causing harm. On the other hand, the complainant stated that even after he sustained injuries, the promoting body failed to compensate the himfor the injuries that he sustained. The attorney read to the court all the clauses that are stated in the Mohamed Ali Boxing Reform Act; he emphasized on the part that stated that there would be compensation for any injury that is realized inside the ring or during the fight. He further argued that during the time when the boxers were being taken for medical tests; the fight had not yet begun. Therefore, whoever broke the fight was supposed to face the court as an individual but not as the boxing body (Burstein, 2003).

According to the Mohamed Ali Boxing Reform Act, whenever the boxing promoters are organizing an event, all the copies of the agreement file must be signed by both the opponents’ team and the supervising team. The promoter should also make sure that every boxer is given the information needed for the match like the amount of consideration and the compensation that the promoter is bound to receive from the match. The act also states that any fight or injury that is caused outside the ring or before the beginning of the match will be punished by the states since it would not be termed as an injury obtained during the event (Burstein, 2003). According to the defendant, the harm to the plaintiff and failure of compensation was not possible due to the fact the fight broke out before the real event started; the boxers fought on the way to the medical test. This led to the injury on the boxer. Consequently, his career ended since he could not manage to participate in boxing matches anymore. The demand from the plaintiff’s side was that the boxer was supposed to be compensated since it is guaranteed in the Act (Burstein, 2003).

After presentation from both the defendant and plaintiff sides, the judge made a ruling. The judge held that according to the Ali’s Boxing Reform Act, the promoters were found innocent because the fight broke out before the intended match. The same Act also found the boxer who caused the injuries on his opponent guilty of the charges since he failed to honor the Act and the Physical Activity Law and Ethics. Consequently, he inflicted a career-ending injury to the defendant. The judge held that, this consequently affected the defendant’s source of income. In conclusion, this case highlights the importance of ethical behavior in ensuring law and order in the society.
