Acting like Principal Sanderson, on March 30,2013, I compelled by the new policy on drugs and reported Jesse Davis to the police on the basis of an anonymous call. The caller suspected Jesse was possessing drugs in his car and that he was dealing drugs in school. I recounted to the court how Jesse was arrested by inspector Carpenter and later I learned Jesse was taken to trial.

At the trial I told the mock court of the anonymous call and the subsequent arrest of Jesse. I also told the court how Jesse was a model student with great grades and active in sports. I mentioned of the rivalry between Jesse and Cam and of their long term friendship and carpooling activities. In the court, I testified that Jesse and Cam were candidates to the coveted valedictorian title and how each of them longed for the title as it would guarantee the winner a scholarship in college. I also confirmed that Cam was recently in the company of students suspected of using drugs. I informed the court that Jesse’s car was not exactly parked in the school premises.

The acting prosecutor Alex and second prosecutor Victoria brilliantly showed the court how Jesse was found in possession of drugs. They also ascertained ownership of the drugs as belonging to Jesse as the DNA material found in the package was a perfect match and that the car belonged to the defendant. They also tied the substantial amount of cash 300 dollars on the defendant insinuating he was involved in drug dealings at school even though his performance record indicated otherwise.He was not a user which was a smart move since Jesse’s character did not portray any evidence of drug use and the fact that he was not under the influence of oxycodone at the time of his arrest.

The defense consisting of attorney Leya and attorney Ronie performance was not as impressive as compared to that of the prosecution team. They presented their theory to the court that the drugs were planted in Jesse’s car and the perpetrator got the police to search his car. They also claimed that the drugs were more likely to belong to Cam and wondered how the inspector did not arrest him since he did not have the DNA results of the piece of hair found in the drugs package. They also helped the court explore the current development in the friendship of Cam and the defendant. In particular, the ensuing rivalry for the valedictorian and the constant arguments spurred by Cams alleged marijuana use and the company he kept. Leya and Ronie proved at the court how Cam had a motive as he could have easily found Jesse’s hair since he had the car keys. However, the defense failed to provide conclusive concrete evidence to affirm their theory.

            The court should also determine if Jesse had parked his car in the school premises or not. This was a significant to this case. This factor is relevant since Inspector Carpenter did not possess a signed warrant to search the car and the new policy on drugs in school did not apply. Thus, the inspector’s acts could be construed to be an invasion of privacy and trespass which makes the search illegitimate and subsequent evidence from the car would be inadmissible in a court of law and could change the case tremendously.

If I was a juror in this case, I would vote for a not guilty verdict. This is because the prosecutors failed to deliver indisputable and conclusive evidence that could prove Jesse’s guilt without a shadow of doubt. The fact that Jesse and Cam werefriends means that Cam could have easily obtained a thread of hair, planted it together with the drugs in the car and asked someone to call the hotline number. Evidence of Jesse’s good character would also be a motivation for this verdict. The fact that the prosecution failed to deliver indisputableand compelling evidence that proves without a shadow of doubt that the drugs belonged to the defendant and that the money he had was drug money,means the defendant should beacquitted of all charges as the burden of proof lied with the prosecution.

The concept of burden of proof and its various standards are evident in the mock trial. The burden of proof in this criminal case lies with the prosecutors who fails to satisfy clear and convincing evidence and beyond reasonable doubt standards of this concept. However, prosecution meets the standards of reasonablesuspicion, probable cause of arrest and substantial evidence of onus probandi.

The concept of evidence admissibility is also applied in this mock trial so as to determine if evidence such as the DNA material can be accepted or if a witness’s testimony can be considered as evidence of the defendant’s character for example,Principal Sanderson’s testimony on the character of Jesse.
