Encryption

Computerization has been embraced in the modern world and this can be attributed to technological advancement. Almost every individual worldwide uses computers. However, privacy and confidentiality must accompany the use of computers. This is achieved through encryption. The latter involves encoding messages or specific information in a way that it can only be accessed by authorized individuals and parties (Chatterjee & Sarkar, 2011). The springing up of computer system hackers is a great blow to encryption. This has made it unable to prevent interception though it denies the view or access of message content by interceptors. In criminal cases, forensic examiners face challenges in trying to access information of the accused due to encryption and this is the point of focus in this paper.

In criminal cases, provision of evidence is vital. Prosecutors and Forensic Examiners must always provide tangible evidence in order to prosecute criminals. However, this varies from country to country. In the UK, if an individual commits serious crimes like child pornography, murder, fraud and tax evasion and refuses to confess or plead guilty, then a provision by the Regulation of Investigatory Powers Act of 2000 requires the accused persons to provide their passwords to facilitate the decryption of information to government representatives under a court order. This is in contrast to the US where the constitution protects accused persons from forceful incrimination, where their computers are decrypted for access to vital information. Essentially, in case an accused person is guilty of committing serious crimes such as child pornography, murder, fraud or tax evasion, the states should force them to supply decrypted information and keys to government representatives. This is because such crimes are serious and are a threat to human life and economic development hence should be eradicated completely.

Civil cases involve disagreements between two or more individuals or parties. In such cases, the defendant should provide tangible evidence to the court and has no right of breaching the privacy and confidentiality of the accused. Therefore, if the case in the scenario was civil, then the Forensic Examiner would not decrypt the accused person’s hard drive with the aim of accessing information.
