Reasonable Accommodation and Undue Hardship

Reasonable accommodation entails adjustments to remove barriers that would hamper a disabled worker from normal performance in the job. The law provides in Title I of the Americans with Disabilities Act (ADA) that employers should provide “equal employment opportunity for individuals with disabilities” (EEOC n. d), and offer reasonable accommodation to qualified but disabled job applicants and employees. The ADA law was meant to protect the disabled from undue discrimination, by requiring fair treatment and support for the disabled (University of Scranton, 2012). One of the reasonable accommodations stated in ADA is modifying the work environment in order to enable normal performance of the job by the recruited person with disability. In the case of Dunix, changing the computer system and structural changes to building would be the required accommodation.

Dunix is a covered entity in ADA because they have 15 employers as stated in the Act. Provision of reasonable accommodation is, however, limited to the financial ability of the employer, and should not amount to unjustified hardship to the employer (EEOC n. d). Cost of implementing the accommodation should consider the employer resources, work operations and any disruptions that would occur in the work place. The employer can seek financial input from a rehabilitation agency or the potential employee towards providing the accommodation (EEOC n. d). In view of the $200,000 annual profits earned by Dunix Company and the small number of employees, $30,000 would not be too much for the company. Therefore, unless the changes in computer systems would need further cost to train the rest of the employees, Ms. Jones is entitled to take legal action if the company does not provide the accommodation.
